Abstract

Penelitian ini mengkaji ketidakpastian hukum dalam Pemutusan Hubungan Kerja (PHK) akibat kesalahan berat (serious misconduct) di Indonesia setelah pembatalan Pasal 158 UU Ketenagakerjaan oleh Mahkamah Konstitusi. Meskipun pemerintah telah memperkenalkan konsep "pelanggaran bersifat mendesak" melalui PP No. 35 Tahun 2021, kebijakan ini dinilai belum memberikan parameter objektif yang jelas sehingga memicu perbedaan penafsiran di tingkat pengadilan. Dengan metode penelitian yuridis-normatif dan pendekatan komparatif terhadap sistem hukum di Singapura, Malaysia, dan Inggris, riset ini mengusulkan rekonstruksi hukum yang memisahkan antara tanggung jawab industrial dan proses pidana. Hasil penelitian merekomendasikan agar Indonesia mengadopsi prinsip due inquiry (penyelidikan internal yang adil) dan doktrin repudiatory breach untuk menilai pelanggaran kontrak secara mandiri tanpa harus menunggu putusan pidana, guna menjamin kepastian hukum bagi pengusaha sekaligus melindungi hak konstitusional pekerja.
