TRIPS Waiver: Pembelajaran dari Pandemi Covid-19

Abstract
Penelitian ini mengkaji dampak TRIPS (Agreement on Trade-Related Aspects of Intellectual Property Rights) terhadap sektor farmasi dan teknologi serta relevansinya dengan TRIPS Waiver dalam mengatasi pandemi Covid-19. TRIPS merupakan perjanjian multilateral yang ditandatangani oleh anggota Organisasi Perdagangan Dunia (WTO) pada tahun 1994, yang memberikan perlindungan hak paten obat selama minimal 20 tahun. Namun, hal ini mempengaruhi akses negara-negara berkembang terhadap obat-obatan dengan harga terjangkau. Di tengah pandemi Covid-19, beberapa negara berkembang, seperti India dan Afrika Selatan, mengajukan proposal TRIPS Waiver untuk mencabut sementara perlindungan hak kekayaan intelektual (HKI) terkait teknologi Covid-19. Tulisan ini menggunakan metode penelitian yuridis normatif dan analisis data deduktif untuk membahas pengaruh TRIPS dan implikasi TRIPS Waiver dalam mengatasi krisis kesehatan global.
